Terms of Service

The fine print, minus the fog.

These terms are the agreement between you and TripFlair. Every section comes with a plain-language summary — the summary helps you understand, but the full text is what governs.

1. The agreement

Accepting these terms

In shortUsing TripFlair means you agree to these terms. You must be an adult.

By creating an account or using TripFlair ("the Service"), operated by [LEGAL ENTITY NAME] ("TripFlair," "we," "us"), you agree to these Terms of Service and our Privacy Policy. You must be at least 18 years old and able to form a binding contract to use the Service. If you use TripFlair on behalf of a business — for example, on our Pro plan — you confirm you have authority to bind that business to these terms.

2. What TripFlair is

The Service — and what it isn't

In shortWe help you plan trips and print brochures. We are not a travel agency and we don't book anything for you.

TripFlair is a trip-planning tool that helps you build itineraries, collaborate with your travel companions, and generate printable travel brochures. TripFlair is not a travel agency, tour operator, or booking service. We do not make, hold, or manage reservations, tickets, or travel arrangements of any kind. Any booking you make — including through links in the Service — is a transaction between you and that third-party provider, governed by their terms, not ours.

Some links in the Service are affiliate links, meaning we may earn a commission if you make a purchase through them, at no extra cost to you. These are marked in the app.

3. AI-generated content

Itineraries are suggestions, not guarantees

In shortOur AI is a smart planning assistant, not an oracle. Verify hours, prices, and bookings before you rely on them.

Features like Launch Pad, Concierge, and Trip Intel use artificial intelligence to generate itineraries, recommendations, and travel insights. AI-generated content can be incomplete, outdated, or wrong — opening hours change, attractions close, prices move, and drive times vary. All AI output is provided for planning purposes only, "as is," without warranty of accuracy. You are responsible for verifying details — especially operating hours, reservations, ticket requirements, border and documentation requirements, and safety conditions — before relying on them or making purchases.

You own the brochures and trip plans generated for you and may print, share, and use them freely, subject to Section 6.

4. Plans & payments

One-time trip passes

In shortTripFlair is free to plan with. Unlocking a trip is a one-time payment for that trip — there is no subscription, nothing renews, and what you unlock stays unlocked.
5. Your content

Your trips belong to you

In shortYou own everything you put into TripFlair. You give us just enough permission to make the product work.

You retain full ownership of the content you add to TripFlair — itineraries, notes, photos, memories, and traveler details ("Your Content"). You grant us a limited, non-exclusive, worldwide license to host, store, process, display, and reproduce Your Content solely to operate and provide the Service — for example, saving your trips, rendering your brochures, generating AI insights you request, and showing shared trips to collaborators you invite. This license ends when you delete your content or account, except for minimal copies in routine backups that expire on their own schedule.

You are responsible for Your Content, including having the rights to any photos you upload and consent from the people in them. If you choose to make a trip public in the Discovery feed, you're granting other users permission to view it (private details like invite links are never exposed).

6. Our content

What belongs to TripFlair

In shortThe software, designs, templates, and brand are ours. Your finished brochures are yours to use.

The Service — including its software, design, brochure templates, layouts, brand, and the TripFlair name and logo — is owned by us and protected by intellectual property laws. We grant you a personal, non-transferable license to use the Service under your plan. Brochures and trip documents generated through your account are yours to print, share, and use, including for your clients on the Pro plan. You may not resell access to the Service itself, white-label it, or extract our templates for a competing product.

7. Acceptable use

The rules of the road

In shortDon't abuse the Service, scrape it, break into it, or use it to harm others.

You agree not to:

8. Families & collaboration

Shared trips and invited members

In shortYou control who joins your trips, and you're responsible for those invitations. Kids' details are added under a parent's account.

Trip owners can invite others to view or edit a trip. You are responsible for who you invite and for the roles you assign. Anyone with an invite link you share can join your trip until you revoke access. Information about children may only be added by a parent or guardian to their own trips; accounts themselves are for adults only. Collaborators' contributions (like memories and photos) remain those collaborators' content, licensed to the trip owner and to us as needed to display them within the trip.

9. Pro plan

Using TripFlair for clients

In shortIf you plan trips for clients, their data is your responsibility to collect lawfully.

If you use TripFlair to plan trips for clients, you confirm you have your clients' consent to enter their information into the Service, you will handle their data in accordance with applicable privacy laws, and you remain responsible to your clients for your own services. TripFlair provides the planning tools; the professional relationship with your clients is yours.

10. Termination

Ending the relationship

In shortYou can leave any time and take your data's deletion with you. We can close accounts that break the rules.

You may stop using TripFlair and delete your account at any time from your settings; deletion permanently removes your account and content as described in our Privacy Policy. We may suspend or terminate your account if you materially breach these terms, with notice where practicable. If we discontinue the Service entirely, we'll give you reasonable advance notice and the opportunity to export your trips. Sections that by their nature should survive termination (ownership, disclaimers, liability limits) survive.

11. Disclaimers

Provided "as is"

In shortWe work hard to keep TripFlair reliable, but we can't promise perfection — in the software or in travel itself.

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Without limiting Section 3: weather forecasts, drive times, border wait estimates, prices, and third-party information surfaced in the Service are best-effort data from external sources and may be inaccurate. Travel involves inherent risks and changing conditions; you are responsible for your own travel decisions, documentation, insurance, and safety.

12. Liability

Limits on our liability

In shortOur liability is capped at what you've paid us in the last 12 months.

To the maximum extent permitted by law, TripFlair will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or travel losses (including missed reservations, cancellations, or costs incurred in reliance on itinerary content). Our total liability for any claim arising from the Service is limited to the amounts you paid us in the 12 months before the claim arose, or $50 if you've paid nothing. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you. You agree to indemnify us against claims arising from Your Content or your violation of these terms.

13. Governing law

Disputes

In shortTalk to us first — most issues are fixable with an email.

These terms are governed by the laws of [STATE/PROVINCE, COUNTRY], without regard to conflict-of-law rules, and disputes will be resolved in the courts located there, except where your local consumer law gives you rights that can't be waived. Before filing any claim, you agree to contact us at hello@tripflair.net and give us 30 days to work it out informally — we genuinely prefer fixing problems to litigating them.

14. Changes

When these terms change

In shortWe'll email you before significant changes take effect.

We may update these terms as the Service evolves. For material changes we'll notify you by email or in-app notice at least 14 days before they take effect; continuing to use the Service after that date means you accept the updated terms. The "Last updated" date at the top always reflects the current version. If any provision is found unenforceable, the rest remains in effect. These terms plus the Privacy Policy are the entire agreement between us regarding the Service.
